End User Terms & Conditions
Last updated: 19/3/2024
1.These terms
1.1 What these terms cover. These are the terms and conditions on which we supply Tickets to you.
1.2 Why you should read them. Please read these terms carefully before you submit your Ticket purchase order to us, as they will form part of the contract between you and us and, where applicable, you and the Event Organiser. These terms tell you who we are, how we will provide the Tickets to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
2. Information about us and how to contact us
2.1 Who we are. We are BookGoDo Ltd a company registered in England and Wales (“we” and “us”). Our company registration number is 12711888 and our registered office is at 4 Mason Court Gillan Way, Penrith 40 Business Park, Penrith, United Kingdom, CA11 9GR.
2.2 How to contact us. You can contact us by emailing our customer service team at hello@bookgodo.com or by writing to us at BookGoDo Ltd, 4 Mason Court Gillan Way, Penrith 40 Business Park, Penrith, United Kingdom, CA11 9GR.
2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. You must provide an email address in order for us to complete your purchase(s) and send your Ticket(s) to you. On registering an account with us, you will also need to provide a password, which must be used in order to access certain restricted parts of the Website. This is personal to you and is not transferable.
2.4 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
3. Interpretation
3.1 In these terms;
(a)”Event(s)” means the individual event or events advertised on our Website for which Tickets are available.
(b)”Event Organiser” means a third party supplier or suppliers of Tickets for the Events which may include a venue, performer, promoter or event organiser.
(c)”Tickets” or “Bookings” means rights to admission to the Event in the form of unique Booking references [and Barcodes].
(d)”Website” means www.bookgodo.com or any other domain or sub-domain upon which we make Tickets available for purchase and through which we promote Events.
4. Our contract with you
4.1 How we will accept your Ticket order. Our acceptance of your Ticket order will take place when your payment has been cleared and we email you to confirm your order, at which point a contract will come into existence between you and us.
4.2 If we cannot accept your order. If we are unable to accept your Ticket order, we will inform you of this and will not charge you for the Ticket. This might be because the Event is sold out, or because we have identified an error in the price.
Please note: we do not purchase the Tickets, set the Ticket prices, nor determine seating locations at the Event. We are an agent of the Event Organiser, responsible for advertising, selling and delivering Tickets on the Event Organiser’s behalf. We collect the Ticket money on behalf of the Event Organiser and supply details of your booking to them. Ownership of the Tickets and rights to grant entry to the Event remains with the Event Organiser and does not pass to us at any time.
4.3 Your Ticket reference. Rights to admission for Events are sold in the form of unique Booking references [or Barcodes], which are delivered electronically via this Website when we accept your order. It will help us if you can tell us the Booking Reference number whenever you contact us about your order.
5. Booking your Tickets
5.1 To buy Tickets, you can either register an account with us, or log in to an existing account you have via the My Account section of the Website, although registration is not necessary for most ticket purchases.
5.2 Please see our Privacy Policy for further information about how we will use your personal data. You must not use our Website or any services available via it if you do not accept this Privacy Policy and our terms and conditions.
5.3 You must be over 16 years old to buy Tickets using this Website and must also comply with any age or other restrictions that apply to the venue where the Event is being held (as set out below).
5.4 All Tickets offered for sale on our Website are subject to availability and subject to changes made by the Event Organiser.
5.5 You may choose the Tickets you wish to purchase on the Website and add them to your ‘basket’. The order process allows you to check and amend any errors in your order for Tickets at each stage of the process. Please check your purchase carefully before you confirm your purchase and check out by proceeding from the basket page. At this stage an offer has been made by you to purchase the Tickets selected.
5.6 When you place an order for Tickets, you must only order Tickets that are of the appropriate category for the individual or group of individuals who will attend the Event using those Tickets. For example, if you are an adult purchasing a Ticket for you to attend an Event, you will not purchase a children’s Ticket. The Event Organiser reserves the right to refuse entry to an Event to any person who they reasonably believe does not hold the appropriate category of Ticket.
5.7 Once you have offered to purchase the Tickets then, subject to their availability at advertised prices and checking your payment details, we will accept your offer and confirm your Booking by displaying your unique Booking reference [and Barcode].
5.8 After you place an order, you will also receive a confirmation email. The contract between us, and between you and the Event Organiser in the case of tickets booked direct with the Event Organiser, will only be formed and your order for Tickets will only be accepted (and your Ticket will only become valid) when payment has been taken in full in cleared funds for the Tickets you have ordered and when we have sent you a confirmation email. To the extent that there is any delay between taking payment and the confirmation email being sent to you, you acknowledge and agree that you have consented to us taking funds from your bank account (to the value of the order you have submitted). You are advised to check your purchase on receipt of confirmation from us.
5.9 When we accept your offer to buy a Ticket pursuant to clause 5.8, we will charge you via your chosen payment method with the face value of the Ticket plus a Booking Fee where applicable. The face value and booking fee will be clearly itemised in your basket before you confirm your purchase and check out. We forward the face value of the Ticket to the Event Organiser, less any commission agreed between us and the Event Organiser. The booking fee is the separate charge we make to you for facilitating the Booking (and is inclusive of VAT). If you require a VAT receipt for the face value of the Ticket you must contact the Event Organiser.
5.10 Until your payment is processed and accepted by us the unique Booking reference [and Barcode] will not be valid.
5.11 The Tickets you purchase are for personal use only. You (and other individuals for whom you have purchased Tickets) must not re-sell or transfer (or attempt to re-sell or transfer) your Tickets to any third party. If you do not comply with this requirement, the Event Organiser reserves (and we reserve for and on behalf of the Event Organiser) the right to cancel the Tickets you have purchased, without notifying you and without any obligation to refund the price you have paid and/or any other compensation and without any other liability to you.
5.12 Please keep your unique Booking reference [and Barcode] in a safe place as you may be refused entry to the Event without it.
6. Ticket prices
6.1 The prices of the Tickets will be as quoted on our Website from time to time. We take reasonable care to ensure that the prices of Tickets quoted on our Website are correct at the time they are entered. However if we or the Event Organiser discover an error in the price of any Tickets you ordered, please see clause 6.3 for what happens in this event.
6.2 Prices for Tickets may change from time to time, but changes will not affect any order for which we have received payment in full in cleared funds and we have confirmed with a confirmation email.
6.3 It is always possible that, despite the Event Organiser’s and our reasonable efforts, some of the Tickets on our Website may be incorrectly priced. If the Event Organiser discovers an error in the price of the Tickets you have ordered prior to us receiving payment in full in cleared funds from you and prior to sending you a confirmation email, we will inform you of this error and we will give you the option of continuing to purchase the Ticket at the correct price or cancelling your order. If we are unable to contact you using the contact details you provided during the order process, we and the Event Organiser will treat the order as cancelled and notify you in writing. We will also refund to you the price you paid in advance (if any) for any Ticket in respect of which an order is cancelled or treated as cancelled under this clause 6.3.
7. Event Organisers and venues
7.1 All details about Events advertised by us are provided on behalf of the Event Organiser and are supplied by the Event Organisers themselves. You are strongly advised to check Event details with the venue at which it is to be held and/or the Event Organiser before travelling to an Event. We make the best efforts to keep all information as up to date as possible, but we cannot be held responsible for any errors.
7.2 Tickets are issued subject to the rules and regulations of the Event Organiser issued at the venue. Full details are available from the Event Organiser on request. Event Organisers may impose additional terms and conditions on you which will apply to the Event they are operating and/or your Ticket. You and all other Ticket holders in your party must comply with all such additional terms and conditions, relevant statutes, safety announcements and venue regulations whilst attending the Event.
7.3 Such additional terms and conditions, as provided by the Event Organiser, have been made available to you as part of the Ticket purchase process (“Additional Organiser’s Terms“) and they will form part of your contract with the Event Organiser. You must comply with those terms and conditions in addition to these terms. If there is any contradiction between these terms and the Additional Organiser’s Terms, these terms will prevail.
7.4 When you arrive at the Event you have booked, you must be able to provide your unique Booking reference, your name, your email address, and either photographic or signature identification. Only the person in whose name the Booking has been made needs to provide this information; persons in their party arriving with them do not, though each person will have to provide proof of age or concessionary status where these are applicable.
7.5 Some Events and Ticket types have age restrictions, and we will take reasonable efforts to ensure these are detailed in the Event information. Please read all the information that applies to the Event you are booking and bring a proof of age if appropriate.
7.6 We offer you the opportunity to buy Tickets from a number of Event Organisers through this Website. We exclude liability for any Tickets or other goods provided by Event Organisers or other third party suppliers to the fullest extent permitted by law. In no circumstance shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with this agreement or purchases made through this Website save where such liability cannot be excluded by law.
7.7 Any dispute regarding the content or quality of the Event, or any actions of the Event Organiser, venue, performers or their representatives is deemed to be between you and the Event Organiser.
8. Delivery of your Tickets
8.1 We will send the Tickets you have ordered through the Website to the email address you provide to us during the order process. Where you have ordered Tickets direct with the Event Organiser, either via the Website or through the Event Organisers direct booking system, the Event Organiser shall send the Tickets directly to you in accordance with the Additional Organiser’s Terms. If you have not received the Tickets you have ordered within 24 hours of our confirmation email, please check your “junk mail” folder before you contact us, or the Event Organiser as applicable, as your Tickets may have been filtered into your junk mail folder, depending on your email preferences.
8.2 If you have not received the Tickets you ordered through us (i.e. by email) by 72 hours before the Event is scheduled to start, please contact us (see “information about us” above) and provide us with details of the order you submitted (i.e. your full name, your full address and the email address you included in your order for Tickets) and a contact telephone number. Following receipt of those details, we will attempt to resolve the issue with you as soon as possible and re-send your Tickets to you at the email address you gave to us in your order. If you ask us to send your Tickets to a different email address to the one set out in your order, we may ask you to provide us with satisfactory evidence of your identity to confirm your name and address, before we will re-send the Tickets to that different email address. We are unable to cancel any Tickets without the authorisation of the Event Organiser.
8.3 For the avoidance of any doubt, the confirmation email received is not a Ticket.
8.4 The Tickets will be your responsibility from their delivery. You should check all the Tickets you receive against your order as soon as possible to make sure they reflect what you ordered and that they are as described. If you discover that the Tickets do not reflect what you ordered or that they are not as described, you must tell us as soon as reasonably possible after discovering this, by contacting us (see “information about us” above).
9. Cancellations and refunds
9.1 All purchased Tickets are final and cannot be refunded unless:
(a) an Event is cancelled;
(b) an Event is moved to another date and you decide not to retain your Booking for the rescheduled Event; or
(c)details of an Event are significantly changed after an order is placed (significant changes being a change of headline act or venue).
9.2 Only the face value of the Ticket will be refunded if 9.1(a), 9.1(b), or 9.1(c) occurs. Ticket booking fees are non-refundable.
9.3 If an Event is cancelled, rescheduled, or the details are significantly changed, and we have been informed of the change by the Event Organiser, we will contact you as soon as possible by email using the details you have supplied via the Website. If you do not receive this notification because you have not updated the email address that we hold in your account, we cannot be held liable. We also cannot be held liable should the email address we hold in your account be configured in such a way to block or divert into spam or junk folders any emails we send to your email address.
9.4 If an Event is cancelled, and we have been informed by the Event Organiser, we will automatically refund the face value of your Ticket: you do not need to notify us nor claim your refund.
9.5 If an Event is cancelled, and we have NOT been informed by the Event Organiser (and so we have not been able to inform you of the cancellation), you must notify us no later than 48 hours after the Event that you wish to claim a refund.
9.6 If we have been informed by the Event Organiser that the Event is to be rescheduled (as set out in 9.1(b) above), or the details significantly changed (as set out in 9.1(c) above), and we have informed you of the change, we will offer you the choice of retaining your Booking for the rescheduled or changed Event, or obtaining a refund of the face value of the Ticket.
9.7 If you wish to receive a refund you must notify us of your choice as soon as possible, and no later than 4pm on the working day before the original date of the Event, or by 4pm on the Thursday before the original date of the Event in the case of Events where the original date was a Saturday, Sunday or a Bank Holiday Monday. If however we have only notified you in the 48 hours preceding the original date of the Event, you must notify us as soon as possible, and no later than 4pm on the day of the original date of the Event. If we have only notified you on the original date of the day of the Event, you must notify us as soon as possible, and no later than the opening time on the original date of the Event.
9.8 If you do not notify us that you wish to obtain a refund, or you do not notify us within the times set out above, you will be deemed to have chosen to retain your Booking and you will not be entitled to a refund.
9.9 If an Event is rescheduled, or the details are significantly changed and we have NOT been informed by the Event Organiser (and so have not informed you of the change), you must notify us as soon as possible, and no later than 48 hours after the original date of the Event, if you wish to claim a refund.
9.10 If an Event is moved to another date (as set out in 9.1(b) above) or the details are significantly changed (as set out in 9.1(c) above) and you decide to retain your Booking, you shall not be entitled to any refund of the face value of the Ticket, nor the booking fee nor to any other compensation whatsoever.
9.11 In the case of a refund the face value of the Ticket will be credited to you via the payment method used for the original transaction. If this process fails then we will issue a cheque made payable to the name listed in the My Account section of the Website. We will send this cheque via standard Royal Mail post to the address you provided via the Website.
